Welcome to Kiyohana. The terms “we”, “us” and “our” refer to Paul Zwolinski Haar & Visagie, trading as Kiyohana. Our registered office is Kleine Houtstraat 96, 2011DR Haarlem, the Netherlands. We are registered with the Dutch Chamber of Commerce under number 52966232, and our VAT number is NL002441036B85.
We operate this store and website, including all related information, content, features, tools, products and services (the “Services”). The Services are powered by Shopify, which enables us to provide you with a curated shopping experience. These Terms of Service, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, and any other policies referenced herein (collectively, the “Terms”), describe your rights and responsibilities when using the Services.
We sell directly to you through our online store. To provide a reliable service, we work with trusted fulfilment partners who handle warehousing, packaging and shipping of orders. Your purchase contract is always with Kiyohana. By visiting, interacting with, or purchasing from our store, you agree to be bound by these Terms. If you do not agree, you should not use the Services.
1. Access and Account
You must be at least eighteen years of age to use the Services. You may be asked to provide accurate and complete information, including your email address and billing, payment and shipping details. You are responsible for maintaining the confidentiality of your account and for all activity carried out under it.
2. Our Products
We make every effort to display our products accurately. However, colours and appearances may vary depending on your device and screen settings. Ingredients and packaging may be updated from time to time; you should always rely on the label you receive. All products are intended for personal use only and may not be resold without our prior written consent.
3. Orders
When you place an order, you are making an offer to purchase. A binding contract is formed only when we send you an order confirmation email. We may refuse or cancel orders at our discretion, including orders that exceed typical household quantities. All purchases are subject to our Return and Refund Policy.
4. Prices and Billing
Prices are displayed in euros (EUR) and pounds sterling (GBP) and include VAT where applicable. Taxes, shipping charges and any customs duties or import taxes for deliveries outside the EU or UK may apply. We do not issue VAT invoices automatically but can do so on request. You must ensure that your payment details are current and accurate. If your payment provider operates in another currency, conversion rates and fees may apply.
5. Shipping and Delivery
Orders are prepared and dispatched by our fulfilment partners. Delivery times vary depending on the destination and carrier and are provided as estimates only. Risk of loss passes to you once the goods are delivered to you or to a person you nominate. We are not responsible for delays caused by carriers, customs processing, or events beyond our control. Customs duties or import taxes may apply outside the EU/UK and remain the responsibility of the customer.
6. Right of Withdrawal
If you are a consumer in the EU or UK, you may have the right to withdraw from your purchase within fourteen days of delivery without giving a reason. This right does not apply to sealed goods that are not suitable for return for health protection or hygiene reasons once unsealed, which includes most hair care products. 7. Promotions and Gift Cards
Promotional codes are valid for one use per customer, are non-transferable, and expire on the date stated. They cannot be combined with other offers unless explicitly specified. Gift cards are valid for purchases made at kiyohana.com, are non-refundable, and cannot be exchanged for cash except where required by law.
8. Intellectual Property
All content on the Services, including text, images, trademarks and designs, is owned by Kiyohana or its licensors. You may use this content only for personal, non-commercial purposes. Any unauthorised reproduction, modification or distribution is prohibited.
9. Third-Party Tools and Links
We may provide optional access to third-party tools or links to third-party websites. These are provided “as is” without warranties, and your use of them is entirely at your own risk.
10. Relationship with Shopify
The Services are powered by Shopify, but all purchases are made directly with us. Shopify is not responsible for sales, returns or product issues.
11. Privacy and Tracking Technologies
We are the data controller for your personal data. To process and deliver your order, we share relevant details, such as your name, delivery address and contact information, with our fulfilment partners. These partners are contractually obliged to use your data only for the purpose of fulfilling your order and to handle it securely in compliance with applicable data protection laws.
Our website also uses cookies and tracking technologies, including the Facebook Pixel and Instagram Ads tags, to measure the effectiveness of our advertising campaigns and to provide you with relevant offers. These technologies may collect data about your browsing behaviour and device, and may associate this with your Meta profile if you are logged into Facebook or Instagram. Because such technologies are not essential to the functioning of our website, they are only activated with your explicit consent, in line with GDPR, the UK GDPR, and applicable ePrivacy and PECR rules. 12. Feedback and Reviews
If you submit reviews, comments or feedback, you grant us a licence to publish and display them on our Services. We will not use your reviews in advertising without your consent. You remain responsible for ensuring that your submissions are lawful, accurate and not misleading.
13. Errors and Omissions
From time to time there may be errors in product descriptions, pricing or availability. We reserve the right to correct such errors and to cancel affected orders, issuing a full refund where necessary.
14. Prohibited Uses
You may only use the Services for lawful purposes. Prohibited uses include fraudulent orders, unauthorised resale, the transmission of viruses, or any activity that interferes with the security or functioning of the website.
15. Termination
We may suspend or terminate your account at any time if you breach these Terms.
16. Warranties and Liability
Nothing in these Terms affects your statutory rights as a consumer. To the fullest extent permitted by law, our liability for any claim arising from your use of the Services or the purchase of our products is limited to the price you paid for the product concerned. We do not exclude or limit liability for death or personal injury caused by negligence, fraud, or any matter that cannot be excluded by law.
17. Governing Law
These Terms and any disputes arising from them are governed by Dutch law. Consumers in the EU or UK may also bring claims in the courts of their habitual residence, and the mandatory consumer protection laws of that country will apply.
18. Changes to the Terms
We may update these Terms from time to time. If we make material changes, we will notify you in accordance with applicable law. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
